Partner Tang Gongyuan from JunZeJun Law Firm was invited to attend the Hong Kong Theme Forum and delivered a keynote speech

On June 14, 2017, organized by the Hong Kong Chinese Enterprises Association Legal Affairs Steering Committee and Commercial Mediation Commission, and co-organized by Hong Kong Bar Association China Practice Development, the Law Society of Hong Kong  Greater China Legal Affairs Committee, Hong Kong International Arbitration Center, China International Economic and Trade Arbitration Commission Hong Kong Arbitration Center, China Maritime Arbitration Commission Hong Kong Arbitration Center and the Association of China Appointed Attesting Officers, the <Legal Services and Dispute Resolution - the role and advantages of Hong Kong> Legal Forum was held in Hong Kong. As the first professional event organized by the Hong Kong major legal services professional groups, this Forum further explored how Hong Kong to make full use of advantages at legal services and dispute resolution under the "Belt and Road" ("B&R") background.

Mr. Tang introduced the investment situation of Chinese enterprises under the "Belt and Road" background from investment quantity, proportion, time, motivation, field, difficulties and other perspective. According to the research results, compared with government policy, the marketing factor is still the first driver for Chinese enterprises to invest in the B&R countries. More than half of the enterprises began the investment in the B&R projects in the last three years, and central SOEs and SOEs are the main force of them. Although faced with political instability, unsound legal system and business environment, difficulty in information collection the three major problems, the investment in the B&R countries as a whole got more positive comments.

Mr. Tang also made further discussions regarding the investment preferred countries, the hot area, areas difficult to conduct due diligence or information collection, political risks and government inspection. Chinese enterprises made prominent achievements in the 2016 "Go Global", but also encountered anti-dumping, countervailing, tax and labor disputes and other investment obstacles. In this regard, Lawyer Tang stressed that Chinese enterprises should optimize the company structure, establish compliance systems and risk control mechanisms and pay attention to the design of a multi-mechanism for dispute resolution to prevent and respond to investment disputes.

Mr. Tang Gongyuan believes that together with the rapid growth of international investment arbitration, some Chinese enterprises have successfully safeguarded themselves in oversea investment by using the relevant rules. With further expansion of the "Belt and Road", investment dispute settlement will become the focus point and more and more Chinese enterprises will participate in the application of international rules.
