On the afternoon of August 23 2017, Beijing Arbitration Commission/Beijing International Arbitration Commission (BAC/BIAC) and Banking Association jointly held the forum on dispute resolution in financial investment field and “China Financial and Investment Commercial Dispute Resolution Review (2017)”joint conference. JunZeJun partner Tao Xiuming delivered speeches in the forum.

Mr. Tao Xiuming first introduced the contents of “China Financial and Investment Commercial Dispute Resolution Review (2017)”, and specially introduced asset management dispute resolution issues. He raised that there are business homogeneity, high creditor's rights product ratio, long product chain, high raio of channel business, unsoundness of the foundation assets, inconformity of regulation requirements and regulatory arbitrage problems in the current asset management market. In face of the above issues, on the one hand, it’s important to determine a proper justice goal, ensuring the conformity of fairness, profession and decisions; on the other hand, we should also focus on the dimensions of achieving judgement targets, analyze the transactions correctly, consider the compliance factors and understand the roles of the transaction parties. In respect of the new conditions of financial dispute judgements, Mr. Tao raised his unique viewpoints: first, insist on taking comliance of the laws as standard, which means only the actions violating laws and administrative regulations should be determined invalid; second, quantify accurately and understand regulations correctly as well as keep the notion of fairness and justice; third, keep the principle of honesty and trustworthiness, in respect of which financial institutions should pay more attention of managers’ due diligence, and justice institutes shoud focus more on the protection of investors.

The conference is the third one in the series of the publication conferences of “China Financial and Investment Commercial Dispute Resolution Review (2017)”, discussing varieties of hot issues in the investment and financial field. The conference attracted nearly 270 guests from fields of commercial banks, bank associations, arbitration committees, large state-owned financial enterprises, law firms and medias.
